Terms of Service
Effective January 1, 2019.

1. Acceptance. By creating an account or using Peach Mindfulness (the “Service”), you agree to these Terms. If you don’t agree, don’t use the Service.

2. What the Service is — and is not. Peach Mindfulness is a digital companion that helps you get meditation into your day, set reminders, start tasks, and offers supportive conversation. The Service is a self-help and organizational tool. It is not a medical device, and it does not provide medical, psychiatric, psychological, or therapeutic advice, diagnosis, or treatment. It is not a substitute for care from a licensed professional. Never disregard professional advice or delay seeking it because of something the Service said.

3. Not for emergencies. The Service is not a crisis or emergency service and cannot respond to emergencies. If you are experiencing a mental-health crisis or thoughts of self-harm, contact emergency services (911 in the US) or call or text 988 (the Suicide & Crisis Lifeline). Peach Mindfulness does not monitor messages in real time and cannot guarantee any message will be seen or responded to.

4. Eligibility. You must be at least 18 years old (or the age of majority where you live) to use the Service.

5. SMS messaging. If you opt in to SMS, you consent to receive recurring automated text messages. Message frequency varies. Message and data rates may apply. Reply STOP to cancel, HELP for help. We honor opt-out requests as required by law and carrier rules.

6. AI-generated content. Responses are generated by automated systems (including large language models) and may be inaccurate, incomplete, or inappropriate. You are responsible for evaluating any information before relying on it. Do not rely on the Service for medical, legal, financial, or other professional decisions.

7. Your responsibilities. You agree to provide accurate information, keep your account secure, and not misuse the Service, attempt to disrupt it, or use it unlawfully.

8. Subscriptions and billing. Paid plans renew automatically until cancelled. You can cancel anytime through email; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.

9. Intellectual property. The Service, including its software and content, is owned by [COMPANY NAME] and protected by law. You retain ownership of content you submit; you grant us a license to use it to operate and improve the Service as described in our Privacy Policy.

10. Disclaimers. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant the Service will be uninterrupted, error-free, or secure.

11. Limitation of liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, Peach Mindfulness WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE.

12. Indemnification. You agree to indemnify Peach Mindfulness against claims arising from your misuse of the Service or violation of these Terms.

13. Changes. We may update these Terms; material changes will be communicated through the Service or by notice. Continued use after changes means you accept them.

14. Governing law. These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules.
